Edgefield County Circuit Court Overview

A criminal case may begin with the Sheriff's Office or a municipal police department, then pass through Bond Court or Magistrate Court for bond, preliminary matters, or warrant activity. Edgefield Civil and Criminal Divisions

General Sessions is the criminal division. A charge record alone does not prove conviction; the disposition or final order is needed.

Family Court is separate from Circuit Court in ordinary routing, even though the Clerk of Court has a Family Court division. Divorce, custody, child support, adoption, name-change, juvenile, and DSS matters go to Family Court. Probate Court is also separate and handles estates, marriage licenses, guardianships, conservatorships, and mental-health commitments. 11th Judicial Circuit

Edgefield County is in the 11th Judicial Circuit with Lexington, McCormick, and Saluda Counties. South Carolina has 16 judicial circuits, and the state Circuit Court page says 49 circuit judges serve those circuits on a rotating basis with assignments determined by the Chief Justice based on Court Administration recommendations. That means a Circuit Court judge serving Edgefield County may not be a county-only judge.

Municipal courts handle municipal ordinance cases and offenses inside a municipality, including many traffic and lower criminal cases. The research did not locate a separate Edgefield County page for each municipal court, so municipal ticket or warrant questions should be verified with the issuing town or city police or court. Some municipal records may appear in the Public Index, but non-appearance in Public Index does not prove no municipal case exists.
